Re: the cons, I couldn't have said it better. She's way too moderate. Also now is the time Obama could have picked a more progressive, outspoken judge. The dems have the numbers to get his nominee confirmed. And I'm a little tired of positioning himself for the next election cycle. Don't get me wrong I want him and other dems to solidify their positions. Now is the time for him to spend some of his political capital and get health care and energy reform passed, without so many compromises that make the new reforms worthless.

I just read on CNN that Obama was looking for someone strong enough and persuasive enough to keep Justice Kennedy swinging to the liberal side of the court. I believe it because that's the kind of reasoned, purposeful action that Obama's all about--and it's definitely one of his strengths. I just hope she herself doesn't become a swing vote.

That's it - that's my concern. Can we count on Sotomayer or is she another Kennedy or God forbid another unexpected justice like Souter and go to the right.
